Department
of Corrections Groundskeeper Agreement
The
Union has reached agreement with the Department
of Corrections on the issue of Correctional Officers
supervision of Inmate Ground Keeping Crews on
institutions grounds, outside the security perimeter.
This agreement was reached as part of the settlement
in the Unit Work Arbitrator Award that the Union
won in August of 2002. We are still working to
resolve, the still outstanding issue of supervision
of Inmate Grounds Crews inside the institution
grounds.
If you are working in Correctional Institution
and see a violation of this agreement contact
your Union Representative at once. This fight
with the department on Corrections Officers doing
Unit 12 work has taken over five tears to win,
it is important that we enforce the agreement,
and require the institutions to use our members
in the supervision of grounds crews.

Automotive
Technician Agreement
(This is a true
copy of the signed Side Letter Agreement re Automotive
Technicians)
Side Letter
Unit 12
INTERNATIONAL
UNION OF OPERATING ENGINEERS
AND
STATE OF CALIFORNIA
The International Union of Operating
Engineers (IUOE) and the State of California (Department
of Personnel Administration and California Highway
Patrol) hereby agree as follows:
- The State of California
agrees to implement the findings and recommendations
of the classification study completed on the
CHP Automotive Technician classification as
follows:
a.
Reallocate all field Automotive Technician
I positions to the Automotive Technician II level.
b.
All field Automotive Technician II positions
with lead responsibility will receive a 5% lead
differential.
c.
All Automotive Technician positions assigned
to the Motor Transport functions will remain allocated
at their current levels.
d.
The Union and the State will jointly support
a classification specification revision to encompass
the CHP Automotive Technician classification study
findings and recommendations.
2. This Agreement shall be effective
upon ratification by the legislature and the union’s
membership of the July 1, 2001 Unit 12 Agreement.

- The
contract was ratified and the terms of the above
agreement became effective on October 1, 2001.
However, subsequently, citing the inordinate
time that the State took in its investigation
and recommendations, coupled with the financial
crisis that delayed negotiations, the Union
re-negotiated the effective date to become effective
on August 1, 2001. Salaries of Field Auto Tech
I and II in the above categories will be paid
retroactive to August 1.
- Why
has the increase not shown up in your pay-checks?
All data was sent to the State Personnel Board
(SPB) to approve the revised classifications
and allow implementation of the agreement. The
SPB, after review, much to the surprise of the
DPA, CHP, and the Union, disapproved the revisions.
They determined that the automatic reallocations
were not in accord with “merit principles”
and required a new classification name and specifications.
These specifications are being prepared now,
it will probably take a few months to be completed
and re-submitted to the Union and then to the
SPB for approval.
- While
this process is taking place, all of the monetary
provisions will be implemented in the form of
“differential pay” rather than salary
for the classification. Salary increases cannot
be paid until the classifications are approved
by the SPB. CHP is at this date keying into
the computer all of the eligible employees for
payroll purposes. Your retroactive checks will
hopefully be received at the end of this payroll
period, or, at the latest the next payroll period
after that.
- Sorry
for all of the confusion and delays, but we
are finally on the last few details and negotiations
that will be necessary to finish what we thought
was going to be a slam-dunk and seems to have
gone on forever.
